About this policy

This policy is for National Direct Finance (Vic) Pty Ltd ("we," "us," "our"), an Australian Privacy Principles (APP) entity as defined in the Privacy Amendment (Enhancing Privacy Protection) Act 2012. It explains who we are, what personal information we collect and why, how we use and disclose it, how you can access or correct it, and how to make a complaint.

Who we are

National Direct Finance (Vic) Pty Ltd is an authorised credit representative (No. 442329) of Australian Credit Licence No. 384428, held by COG Compliance Services Pty Ltd (ABN 29 117 660 938, ACN 117 660 938). We provide credit assistance — we help you apply for finance, and act as an intermediary and independent contractor to assist you to obtain and negotiate a loan. We have access to a panel of financiers and offer a variety of consumer and commercial finance products tailored to your needs and objectives.

What we collect

Personal information is information or an opinion about an identified individual, or an individual who's reasonably identifiable. Depending on the finance you're applying for, this may include:

  • Your name, signature, address, email, phone number, date of birth, and bank account and expenditure details
  • Employment details, such as business address, job title, and salary
  • Credit report information — credit history, credit accounts, repayment history, inquiries, defaults and bankruptcy

We generally don't collect sensitive information (such as health or racial/ethnic information) as it's not necessary for our main function — the exception is if you require information about insurance products we offer, in which case we'll inform you and obtain your consent first.

How we collect it

In most cases we collect your information directly from you when you apply for finance ("solicited information"). Where you consent, we may also collect it from third parties such as employers, accountants, banks, or referrers.

How we use it and who we share it with

We collect your information to provide the finance you've requested, and hold it in accordance with Australia's privacy and credit reporting laws, including the Privacy (Credit Reporting) Code 2024. If we proceed with arranging finance for you, we'll hold your information for seven years after the finance contract ends, then delete what we no longer need.

We may share your information with:

  • Lenders and insurers on our panel, to assess and process your application
  • Credit reporting bodies, to obtain and provide credit information about you
  • Your employer, bank, solicitor, or accountant, to verify information you've provided
  • The supplier of the asset you're purchasing (e.g. a dealership), where applicable
  • COG Compliance Services Pty Ltd, our Australian Credit Licence holder, for compliance and audit purposes
  • Referral partners — we work with a number of other brokers, referring clients to them and receiving referrals from them, depending on what best suits your situation (for example, home loan enquiries — see our Home Loans page). A referral fee may be paid or received as part of these arrangements
  • Your referees or contacts, if we're unable to reach you

Anonymity and pseudonyms

You don't need to identify yourself for a general enquiry — for example, asking about our products or the lenders on our panel. If you apply for finance, though, you'll need to identify yourself, as your information is required to support the application.

Direct marketing

We may use your information to market other products or services to you. If you'd rather not receive marketing material, you can opt out at any time by emailing or calling us — we'll update our records within 30 days.

Government-related identifiers

We may collect identifiers such as driver's licence or passport numbers as part of an application, and may need to disclose these to a lender or insurer as part of their identification process. Tax File Numbers are handled under the Tax File Number Rule 2015 — we take reasonable steps to permanently de-identify any TFN that appears on documents we receive.

How we keep your information secure

We take the security of your personal information seriously. As information is stored both electronically and in hardcopy format, we have a variety of safety measures in place to protect it from misuse, modification, interference, loss, unauthorised access, or disclosure, including but not limited to:

  • Confidentiality agreement requirements for our employees and external representatives
  • Document storage security policies
  • Security measures for access to our systems
  • Restricting access to personal information to authorised staff and representatives who need it
  • Premises security
  • Electronic security systems such as firewalls and data encryption

Where we store personal information physically or electronically with third-party data storage providers, we have contractual arrangements in place to ensure those providers take appropriate security measures and restrict who can access it. In the event of a data breach involving your information, we'll notify you as soon as practicable in line with our obligations under the Privacy (Credit Reporting) Code.

Access, correction & complaints

You can ask us to access or correct the personal information we hold about you at any time by contacting us using the details below. If you believe we haven't handled your information in line with this policy, you can also make a complaint to us directly — most complaints are resolved within days; if we can't resolve it within 30 days, we'll tell you why and give you an expected timeframe.

If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, or the Australian Financial Complaints Authority (AFCA) at afca.org.au.
